Important: These Website Terms govern use of the website. Purchases are governed by the separate Terms and Conditions of Sale, and service jobs are governed by the applicable quote, invoice, and work order.

These Website Terms and Conditions (the "Website Terms") govern access to and use of https://atxgaragegym.com and related webpages, forms, content, and online order-request features (collectively, the "Site"). The Site is operated by ATX Garage Gym LLC ("ATXGG," "we," "us," or "our"). By accessing or using the Site, you agree to these Website Terms and our Privacy Policy. If you do not agree, do not use the Site.

The terms "Terms of Use" and "Terms of Service" refer to these same Website Terms. They do not create a separate agreement.

You must be at least 18 years old and legally capable of entering into a contract to submit an order or service request. If you use the Site for a company, gym, school, apartment community, nonprofit, or other organization, you represent that you are authorized to act for that organization.

The Site is primarily for browsing inventory, learning about services, and contacting ATXGG. A cart, checkout, contact form, or online order submission is only a request to arrange a purchase. It does not by itself complete a sale, reserve equipment, create a delivery obligation, or confirm a service appointment.

A transaction is accepted only after ATXGG directly confirms the item's availability, the final price and applicable taxes or fees, the accepted payment or deposit, and the pickup or local-delivery arrangements. ATXGG may correct errors, update a listing, or decline an unaccepted request. If ATXGG declines a request after receiving money, ATXGG will return the amount received, subject to applicable payment-network processing rules.

Most inventory is used, unique, or limited in quantity and may be sold before the Site is updated. Photographs, model numbers, dimensions, weight-stack information, specifications, colors, condition descriptions, and prices are provided in good faith but may contain errors or reflect configurable equipment. You are responsible for confirming any detail material to your decision before purchase.

Prices may exclude sales tax, delivery, assembly, disassembly, stairs, difficult access, anchoring, wall installation, parts, or other services unless the listing or written quote expressly says those items are included.

All direct purchases from ATXGG are governed by the Terms and Conditions of Sale provided for the transaction. Those sale terms address used-equipment condition, as-is sales, warranty disclaimers, inspection, deposits and holds, payments, pickup, loading, local delivery, assembly, returns, risk of loss, and limitations of liability.

ATXGG does not offer standard common-carrier shipping through the Site. Available fulfillment is pickup by appointment or local delivery that ATXGG expressly confirms. Placing an item in a cart does not create a hold. An item is reserved only when ATXGG accepts a deposit or confirms a hold in writing.

Descriptions of delivery, moving, assembly, design, turnkey gym, flooring, anchoring, wall-installation, or related services are general information, not a fixed offer. Service scope, access assumptions, exclusions, pricing, deposits, schedule, and customer responsibilities must be confirmed in a written quote, invoice, or work order. A job-specific work order controls if it conflicts with a general website description.

When you submit a form, email, text message, checkout request, or other communication, you authorize ATXGG to use the information to respond, prepare a quote, discuss inventory, arrange pickup or delivery, and administer a transaction or service. Standard carrier charges may apply to calls or texts. ATXGG does not currently operate a subscriber marketing-email program. Any future marketing messages will be handled according to applicable law and the choices offered with those messages.

Electronic communications may satisfy legal writing and signature requirements to the extent permitted by law. Transaction-specific acceptance may still require a checkbox, signature, deposit acknowledgment, invoice, work order, or a specified acceptance message.

The Site may link to manufacturers, retailers, payment services, social platforms, maps, or other third parties. Some links may be affiliate links that pay ATXGG a commission if you make a purchase, at no additional cost to you. ATXGG will provide a clear disclosure near affiliate recommendations and maintains a separate Affiliate Disclosure.

A purchase from a linked retailer is between you and that retailer, not ATXGG, unless the page clearly states that ATXGG is the seller. Third-party sites have their own prices, availability, warranties, returns, terms, and privacy practices. ATXGG does not control or endorse every statement, product, or practice on a linked site.

Site content is general business and product information. It is not medical advice, exercise instruction, structural engineering, electrical advice, code advice, or a substitute for manufacturer instructions or a qualified professional. Fitness equipment can cause serious injury or death if selected, installed, anchored, maintained, adjusted, or used incorrectly.

The Site and its original text, photographs, graphics, layout, logos, and other content are owned by ATXGG or used with permission and are protected by applicable intellectual-property laws. You may view and print Site content for personal or internal business evaluation, but you may not copy, scrape, republish, sell, modify, or commercially exploit it without written permission.

Manufacturer names, model names, and third-party trademarks belong to their respective owners. Their appearance does not imply sponsorship or authorization unless expressly stated.

You represent that information, photographs, measurements, reviews, and other materials you submit are accurate to the best of your knowledge and that you have the right to provide them. You authorize ATXGG to use submitted materials as reasonably necessary to respond, quote, inspect, document, schedule, or perform the requested transaction or service. ATXGG will obtain separate permission before using customer-provided content as a public testimonial or marketing feature unless the content was posted publicly for that purpose.

You may not use the Site to:

13. violate law, infringe another person's rights, or submit fraudulent or misleading information;

14. introduce malicious code, interfere with Site security, probe vulnerabilities, or attempt unauthorized access;

15. scrape, harvest, or collect Site or user information through automated means without written permission;

16. impersonate another person or misuse ATXGG's name, contact information, content, or listings; or

17. use the Site in a way that could damage, disable, overburden, or disrupt it.

Our Privacy Policy explains the categories of information we collect, why we use it, when we share it, and the choices available to you. Google reCAPTCHA and other third-party services may also apply their own privacy policies and terms.

The Site is provided on an "as available" basis. To the fullest extent permitted by law, ATXGG disclaims warranties concerning uninterrupted access, security, accuracy, completeness, merchantability, fitness for a particular purpose, and noninfringement as they relate to the Site. ATXGG does not promise that every item, service, feature, or price shown will remain available.

These website disclaimers do not replace transaction-specific promises expressly stated in an accepted invoice, warranty, or work order and do not disclaim rights that applicable law does not allow ATXGG to disclaim.

To the fullest extent permitted by law, ATXGG and its members, managers, owners, employees, contractors, representatives, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from access to or use of the Site or a third-party link. For a claim arising solely from Site use and not from a direct equipment purchase or service, their combined liability will not exceed $100.

Liability relating to equipment sold or services performed by ATXGG is governed by the applicable Terms and Conditions of Sale, invoice, work order, and completion form. Nothing in these Website Terms excludes liability for gross negligence, willful misconduct, or any right or liability that cannot lawfully be waived or limited.

To the fullest extent permitted by law, you agree to reimburse and defend ATXGG against third-party claims, losses, and reasonable costs caused by your unlawful use of the Site, your infringement of another person's rights, or content you submit without authority. This section does not require a consumer to indemnify ATXGG for ATXGG's own conduct where prohibited by law.

Texas law governs these Website Terms, without regard to conflict-of-law principles. Any lawsuit arising solely from the Site or these Website Terms must be brought in a court of proper jurisdiction in Travis County, Texas, unless applicable law requires otherwise.

ATXGG may update these Website Terms by posting a revised effective date. Changes apply prospectively when posted unless a different date is stated. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver.

For a completed or accepted transaction, the version of the applicable transaction documents accepted for that transaction controls unless the parties agree otherwise in writing.
